Tahiti Stock Footage & Photos provides you with an English translation of the Privacy Policy, you acknowledge that this translation is provided for informational purposes only and that only the French version of these document governs the contractual relations between you and Tahiti Stock Footage & Photos.

If the French version of the Privacy Policy and its translation contradict each other, the French language version takes priority.

By accessing or using our website, you consent to the collection, use, processing and sharing of your personal information/data in accordance with this policy. Tahitistockfootage & Photos is committed to protecting your privacy. This policy informs you about the collection, use, processing and sharing of your personal information and the use of cookies. As noted below under “Payment Gateways,” payment information such as your credit/debit card or financial account number is provided directly to a third-party payer through a secure platform and is not accessed or collected by us .- Information you provide to us about your business such as business name, business type.- If you become a Tahitistockfootage & Photos Content Contributor, certain additional information may be requested and collected when you register as a Contributor or edit your Tahitistockfootage & Photos account, including (i) banking and other financial institution or payment gateway information necessary to commission you; (ii) your government taxpayer identification number (TAHITI number in Polynesia), required so that we can prepare tax information documents where applicable; (iii) other information that we determine is necessary to help us market your Content, confirm your identity or rights to the content you provide to us; and (iv) a copy of your photo identification (for example, your driver's license).

You can always choose not to provide personal information, but in this case you may not be eligible as a Contributor or customer of the Website content, or participate or transact on our Website and/or certain other services may not be available. In addition to the above, for each visit to the Website, Tahitistockfootage & Photos collects the IP address and type of device accessing the Website (e.g., mobile phone or desktop), and we store and associate this information with your Tahitistockfootage & Photos Site account.

 

Article 2 - LOCATIONS WHERE YOUR DATA MAY BE STORED OR PROCESSED

 

Data storage and processing

Personal information, common to customers and Site Contributors, collected by Tahitistockfootage & Photos may be stored on our host in France and is processed in French Polynesia where Tahitistockfootage & Photos has its headquarters. Customer information is retained for a period of 3 years. Each reconnection on your part and use of the Site is worth a tacit renewal.

Storage of Content and related data (metadata)

Personal information entered in the metadata of Content files posted by Contributors will follow the files to which they are attached. Thus, in addition to its host in France, and for storage facilities for Content (photos, videos, graphics, audio), Tahitistockfootage & Photos may have to store these Content files in a Data Center in Ireland or the USA (Backblaze ).

By providing us with your personal information and using our website or services, you consent to such transfer of files outside of your country. However, the information contained (metadata or metadata) will under no circumstances be processed by these third-party services.

We will not publicly disclose any personal information about a model.

Article 4 - INFORMATION SHARING


We will share your personal information with third parties only as described in this privacy policy. We do not sell your personal information to third parties. We may disclose your personal information to third party service providers who perform services on our behalf. For example, we may hire other companies to process payments, provide data storage, processing or management, host websites or computer servers, fulfill orders and shipping, assist with marketing, perform audits , etc. (i) are authorized to obtain only the personal information they need to provide the service, (ii) are required by Tahitistockfootage & Photos to protect personal information to the same extent as Tahitistockfootage & Photos and as required by applicable law , including, if they process personal information of individuals residing in the EU, GDPR, (iii) are permitted to use such personal information only for the purposes for which it is provided, and (iv) they are prohibited from use them for other purposes.

Payment Gateways and Processors

The chosen payment method is bank transfer. The bank details to make your payment will be provided to you upon request when validating your online order.

For banking reasons beyond our control, payments via gateways are suspended in the territory of French Polynesia.

We may use Tahitistockfootage & Photos and third party cookies and other tracking technologies to facilitate the use of the Site by users of the Site, for example, to keep track of user preferences, site activities and profile information to access the website. The information allows us to link this information to users' accounts on the Website and verify their credentials. 4. when personal data has been the subject of unlawful processing;

5. when the personal data must be erased to comply with a legal obligation which is provided for by European Union law or the law of the Member State to which the controller is subject;

6. when the personal data have been collected as part of an offer of information society services to children (in accordance with Article 8 of the GDPR) and they therefore concern a minor.

Although this list is exhaustive, it should be noted that it covers a large number of cases. Furthermore, the right to object must also be added, in which case erasure may be requested (see point 3).

Outside of this framework, we will continue to retain and use your personal information when we deem it necessary for the management of ongoing contractual rights and obligations, the establishment, exercise or defense of legal rights or claims or the protection of our contributors on Tahitistockfootage & Photo or the rights of the licensee, which would include our need to comply with our contractual and other legal obligations, to resolve disputes or claims and to enforce our agreements.
